Terms of service.

These terms cover your use of upshiftsales.com (the "site") and the text messages you receive from Upshift Sales ("Upshift," "we," "us"), a Texas business operating under an assumed name registered in Williamson County, Texas. By using the site or opting in to our text messages, you agree to these terms. Services we deliver to a client business are governed by that client's separate written agreement; where the two differ, the written agreement wins.

1. What the site is for

The site describes our services and lets you learn about and book a free sales audit. The content is general information, not a guarantee of results for your business. Numbers on the site are examples or figures from the sources named next to them.

2. Text messaging terms

Program. Upshift Sales appointment and follow-up texts. When you opt in, we send appointment confirmations and reminders, scheduling messages, replies to your questions, and follow-ups about a request or conversation you started. Some messages are written and sent by our software on behalf of Upshift or a client business you are already dealing with.

How you opt in. By checking the text messaging consent box when you book an appointment through our booking calendar, by giving us your mobile number and asking us to text you, or by texting us first. We do not collect text messaging consent through any form on this website.

Frequency. Message frequency varies based on your conversation with us.

Cost. Message and data rates may apply. Check with your mobile carrier for details.

Opting out. Reply STOP to any message to cancel. You will get one final text confirming you are unsubscribed, and we will not text you again unless you opt in again.

Help. Reply HELP to any message for help, or email hello@upshiftsales.com.

Carriers. Our messages are supported on major US carriers. Carriers are not liable for delayed or undelivered messages.

Your number. You confirm you are the owner or authorized user of the mobile number you give us. If you change or give up your number, tell us so we can update our records.

Privacy. How we handle your mobile number and consent is in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

3. Acceptable use

Do not use the site or our messaging to break the law, to send spam or abuse, to scrape or copy the site, or to interfere with how it works. We can block anyone who does.

4. Our content

The site, its text, design, images and the Upshift Sales name and marks are ours or licensed to us. You may view and share the site for your own information. Do not reproduce it for commercial use without our written permission.

5. Links to other sites

The site may link to other websites (for example, a calendar or payment page). We are not responsible for their content or practices.

6. No warranties

The site and our messages are provided "as is." We do our best to keep them accurate and available, but we do not promise that they will be error-free or uninterrupted, and we do not promise any particular business result from the information on the site.

7. Limitation of liability

To the fullest extent the law allows, Upshift is not liable for indirect, incidental or consequential damages arising from your use of the site or our messages. Nothing here limits liability that cannot be limited under Texas law.

8. Governing law

These terms are governed by the laws of the State of Texas. Any dispute about them will be handled in the state or federal courts located in Texas.

9. Changes

We may update these terms. The new version will be posted here with a new effective date. Continuing to use the site or receive our messages after that means you accept the updated terms.
